the Grand JURIX LawSchool Online Preparatory Course, you warrant
that you have read the Terms of Use contained herein and agree
to be bound by them. If you do not agree to be bound by the
Terms of Use, please discontinue using the Grand JURIX LawSchool
Online Preparatory Course.
RESTRICTIONS ON USE OF MATERIALS
This site is owned and operated by Spectrum Business Support
Ltd. (hereinafter referred to as "Spectrum", "we,"
"us" "SBS" or "our"). The contents
have been provided to Spectrum by Universal Law Publishing
Co Pvt Ltd (hereinafter referred to as ULPC). No material
from the Grand JURIX LawSchool Online Preparatory Course or
any Web site owned, operated, licensed or controlled by Spectrum
Business Support Ltd. may be copied, reproduced, republished,
uploaded, posted, transmitted or distributed in any way. Modification
of the materials or use of the materials for any other purpose
is a violation of Spectrum's copyright and other proprietary
rights. For purposes of this Agreement, the use of any such
material on any other Web site or networked computer environment
is prohibited without written authorization from Spectrum.
TERMS AND CONDITIONS AGREEMENT
Spectrum Business Support Ltd welcomes you to the premier
on-line law entrance preparatory testing website. We agree
to introduce you to online testing services. On-line testing
services are not intended as a substitute for medical evaluation,
treatment or consultation. Spectrum agrees to make a reasonable
effort to maintain an informative, useful, and safe website
for the benefit of Students interested in a career in law.
We ask that you carefully review these Terms and Conditions,
and that you read and signal (either click on the "Accept"
text or the "Decline" text located at the end of
this document) that you understand and agree with the Terms
and Conditions detailed within this document.
Please note that you are referred to as "Student"
or "User" in this Agreement. The term "Testing
Service Provider" includes Spectrum Business Support
Ltd and Universal Law Publishing Co Pvt Ltd and the officers,
directors, employees, assigns, agents, and successors of these
two companies.
SERVICES AND CONDITIONS OF USE
Spectrum Business Support Ltd (the "Service Provider")
agrees to provide a Site with appropriate information, coaching
material, and opportunities to learn in order to prepare for
the Law Entrance examinations of various colleges and universities
in India. All of the services provided are subject to the
terms of this Agreement. Service Provider reserves the right
to modify this Agreement at any time by providing notice through
the Site. You hereby agree that, at all times that you use
the Site, you will abide by the Terms and Conditions set forth
herein. To use the Site, User must agree to all of the Terms
and Conditions set forth in this Agreement. Read this Agreement
carefully. Do not use the Site unless you have read and agree
to abide by the terms and conditions set forth herein.
GENERAL DISCLAIMER
The content on the Site is provided for assistance purposes
only and is not intended in any way to be a substitute for
actual examination.
User's reliance on any information provided on the Site is
solely at the risk of the User. Service Provider does not
assume any liability or responsibility for the accuracy of
the content of any material provided on the Site. Service
Provider does not assume any liability or responsibility for
damage or injury to persons or property arising from the use
of any information or material of any nature provided on the
Site. Service Provider reserves the right, at any time, to
modify or to stop providing any component or feature of the
Site.
REGISTRATION
You are required to provide accurate and complete data about
yourself while registering. If the information you provide
is found to be false or if we suspect it to be incorrect,
we have the right to deny you the membership. The registration
is guided by our privacy policy.
USERNAME AND PASSWORD
You need to provide a valid user name and password while registering.
You are responsible for maintaining the privacy of your User
Name and Password. In case of breach of security, you may
inform us immediately.
PAYMENT FOR SERVICES AND CANCELLATION POLICY
User will agree to a fee for services set by Spectrum
Business Support Ltd. Payment is made through the products
page through the online payment facility provided or Draft.
You agree that you own the credit card you are using, or have
the permission of the credit card holder to do so. You cannot
claim and you agree that the Service Provider does not require
to make any refund for any amount paid to Service Provider
under any conditions whatsoever.
USER RULES FOR THE SITE
By using the Site, you agree that you will not undertake any
of the following actions:
- Use the Site for any purpose which would violate any
local, state, national or international law;
- Engage in any other conduct which, in the opinion of Service
Provider, inhibits or restricts others from using and enjoying
the service;
- Impersonate another person;
With or without warning, Service Provider, in its sole discretion,
may terminate User's account when these Rules and/or Terms
and Conditions are violated. Service Provider will also make
every effort to remove material or postings on the Site that
are in violation of the Rules or the Terms and Conditions.
Users who violate the above Rules or Terms and Conditions
of the Site may receive a warning from Service Provider stating
that User has committed a violation and that further violations
may result in the termination of User's account.
If you use the interactive areas found on the Site, you are
solely responsible for your communications and the consequences
of posting those communications. Spectrum does not assume
any liability or responsibility for the content or consequences
of such communications.
COPYRIGHTED MATERIALS
User should assume that any material, information, software,
or any other content on the Site is protected by copyright.
User may not copy, reproduce, retransmit, distribute, publish,
use for any commercial purpose, or otherwise transfer any
copyrighted material. User is solely responsible for compliance
with any copyright, trademark, or other proprietary right,
which may apply, to any material of any nature found on the
Site.
LIMITATION OF LIABILITY AND WARRANTIES
THE SITE AND ALL CONTENT AND MATERIALS ON THE SITE ARE
PROVIDED ON AN "AS IS" BASIS. USER AGREES TO USE
THE SITE SOLELY AT USER'S OWN RISK. TO THE FULLEST EXTENT
PROVIDED BY LAW, SERVICE PROVIDER DISCLAIMS ANY AND ALL WARRANTIES,
EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES RELATING TO
THE QUALITY, ACCURACY, OR CONTENT OF ANY AND ALL MATERIAL,
INFORMATION, PRODUCTS, OR SERVICES POSTED ON OR ACCESSED THROUGH
THE SITE, AS WELL AS ANY WARRANTIES OF TITLE OR OF MERCHANTABILITY,
FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
Service Provider is not liable for the conduct of other Users
or third parties and the risk of injury from the foregoing
rests entirely with User. Service Provider is not liable for
damages of any nature including, without limitation, direct,
indirect, incidental, consequential, or special damages arising
out of User's use of the Site or inability to access or use
the Site or out of any breach of any warranty.
To reiterate and amplify or clarify, the materials in this
site are provided "as is" and without warranties
of any kind either express or implied. To the fullest extent
permissible pursuant to applicable law, Spectrum disclaims
all warranties, express or implied, including, but not limited
to, implied warranties of merchantability and fitness for
a particular purpose. Neither Spectrum nor ULPC warrant that
the functions contained in the materials will be uninterrupted
or error-free, that defects will be corrected, or that this
site or the server that makes it available are free of viruses
or other harmful components. Spectrum does not warrant or
make any representations regarding the use or the results
of the use of the materials in this site in terms of their
correctness, accuracy, reliability or otherwise. You (and
not either Spectrum or ULPC) assume the entire cost of all
necessary servicing, repair or correction. Without limitation
of the foregoing, you acknowledge that as a service to users
of this site, we include links to other sites on the World
Wide Web portion of the internet AND THAT neither Spectrum
nor ULPC have no control over, and make no representations
of any kind whatsoever, regarding the content or appropriateness
of content on such sites, and you hereby irrevocably waive
any claim against us with respect to such sites howsoever
arising.
Under no circumstances, including, but not limited to, negligence,
shall Spectrum or ULPC be liable for any special or consequential
damages that result from the use of, or the inability to use,
the materials in this site or any other site, even if Spectrum
or ULPC or an authorized representative of either organisation
has been advised of the possibility of such damages. Without
affecting any limitation of liability contained herein in
no event shall Spectrum's or ULPC's total liability to you,
joint and severally, for all damages, losses and causes of
action (including, but not limited to negligence or otherwise)
exceed the amount paid by you, if any, for accessing this
site.
SERVICEMARKS AND TRADEMARKS
Spectrum Business Support Ltd, Spectrum, Grand JURIX and Grand
JURIX Law School logos are servicemarks of Spectrum. All other
servicemarks and trademarks appearing on the Site belong to
their respective owners.
NOTICE
Service Provider may give notice to Users by means of a general
notice on the Site. User may give notice to Service Provider
only by means of Registered AD Letter delivered to the Registered
Office of Spectrum Business Support Ltd.
INDEMNIFICATIONS
User agrees to indemnify and hold harmless Service Provider
from any liability, cause of action, claims and expenses,
including reasonable attorney's fees and court costs, related
to a violation of this Terms and Conditions Agreement and
as a result of any information, material, or content placed
on the Site by User.
User hereby releases and agrees to hold harmless and indemnify
Spectrum Business Support Ltd, Universal Law Publishing Co
Pvt Ltd, the respective companies' directors, officers, employees,
agents, successors, advisors, consultants, and assigns from
any and all liability or causes of action and claims of any
nature resulting from the acts of accessing testing services
through the Site.
This Terms and Conditions Agreement shall be governed by and
construed in accordance with the laws of India. If any provision
of this agreement shall be unlawful, void or for any reason
unenforceable, then that provision shall be deemed severable
from this agreement and shall not affect the validity and
enforceability of any remaining provisions. To the extent
permitted by applicable law, the parties hereby waive any
provision of law that renders any provision of this agreement
prohibited or unenforceable in any respect. This is the entire
agreement between the parties relating to the subject matter
herein and shall not be modified except in writing, signed
by both parties. Any dispute arising from this Agreement or
a breach of this Agreement shall be adjudicated under the
jurisdiction of the High Court of Mumbai, if it cannot first
be resolved by alternative methods of dispute resolution.
TERMINATION
This agreement will terminate immediately without notice from
Spectrum if in Spectrum's sole discretion you fail to comply
with any term or provision of this agreement. Upon termination,
you must destroy all materials obtained from this site and
any and all other Spectrum site(s) and all copies thereof,
whether made under the terms of this agreement or otherwise.
ENTIRE AGREEMENT
This Agreement constitutes the entire agreement between the
parties with respect to the subject matter contained herein
and supersedes any and all other agreements, communication
(written or oral) between Service Provider and User. Service
Provider may amend this Agreement or impose new conditions
at any time by notice from Service Provider to User as published
through the Site. Any use of the Site by User after such notice
shall be deemed to constitute acceptance by User of such amendments,
modifications, or new conditions.
It is understood and agreed that if any part, term, or provision
of this Agreement is held by a court to be unenforceable,
unlawful or in conflict with any law of India, the validity
of the remaining terms of this Agreement shall not be altered,
and the rights and obligations of the parties shall be construed
and enforced as if the Agreement did not contain the part,
term, or provision held invalid.
